Prosecutor upgraded the charges to include Attempted Murder against our client’s brother and two counts Second Degree Aggravated Assault against our client. Client faced exposure of up to 10 years State Prison on each count, for a total of 20 years.
Client sat in jail for nearly 5 months.
Entered case July 2008 and filed motion to dismiss based on illegal entry into home. Officers allegedly entered home to arrest defendants for disorderly conduct. Through extensive legal briefs and arguments, Farrow and co-counsel argued that such an entry was illegal, and the arrest and charges were tainted by the illegal search. They eventually succeeded and the charges were dismissed.
The State then appealed the dismissal, and the Appellate Division reversed the dismissal and remanded the matter for a new trial. After several trial dates, the matter was finally listed for trial on October 12, 2011, over four years after the offense date. After a trial that lasted nearly two weeks, the jury returned verdicts of Not Guilty on all charges for Farrow’s client and his brother and mother.
